New Delhi: The Delhi High Court had earlier fined a law student ₹75,000 for filing a petition for the bail of Chief Minister Arvind Kejriwal. This law student has now petitioned the court again to be exempted from the fine.
The fictitious law student Abhishek Chaudhary filed the petition under the title ‘We the People of India,’ arguing that Kejriwal could be in danger inside a jail. The High Court had quashed this PIL on April 22 observing that it lacks merits and had levied a penalty of ₹75,000.
On Monday, the High Court discharged the fine but directed that in the event the petitioner should file any new applications in the future, the petitioner must enclose a copy of the decision of this case. The same bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora had observed that the arguments advanced in the PIL were factually inaccurate and legally unsustainable.
Firstly, it is worth stating that the law student provided an unconditional apology for his misconduct and explained that he would not repeat the same mistake in future. His lawyer again pointed out that the student has gained more understanding in the legal system and wants a full pardon.
The court listened to the submissions and granted the waiver. The bench directed that if the petitioner is to file any new proceedings they should enclose xerox copies of both the April 22 decision and the above order.
